1. Introduction
Welcome to FriendlyCommunitySpace ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at friendlycommunityspace.sbs (the "Service") operated by FriendlyCommunitySpace.
By booking a charter or using our Service, you consent to these Terms. If you do not agree with any section of these terms, you are not permitted to use the Service.
2. Service Overview
FriendlyCommunitySpace offers elite yacht charter services, which include:
- Yacht rentals for the day
- Evening sea tours
- Business outings
- Private celebrations
- Long-term yacht charters
We may alter or cease services without prior notice and services are provided based on availability and weather conditions.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be no younger than 18 years
- Supply valid and thorough details
- Make the required deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A charter is only confirmed with payment receipt and our formal confirmation. We maintain the discretion to deny service to any individual.
3.3 Availability
Charter services are conditional on boat availability and favorable weather. We strive to accommodate your preferred schedule when possible.
4. Payment Terms
4.1 Pricing
All stated prices are in € and include relevant taxes unless specified otherwise. Prices may be subject to changes without prior notification.
4.2 Payment Schedule
- Initial payment: 50% of the entire charter cost required at the time of booking
- Final payment: To be paid 48 hours before the charter leaves
- Supplementary fees (if applicable): Due on charter completion
4.3 Payment Methods
We accept most credit cards, electronic funds transfers, and bank-certified cheques. Payments are processed using secure encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Total amount refunded minus transaction fees
- If canceled between 24 to 72 hours prior to departure: 50% returned
- If canceled less than 24 hours prior to departure: No refund provided
5.2 Weather Cancellations
Should unsafe weather conditions arise as determined by our captain, we will propose to:
- Reschedule the charter for an alternate date at no extra cost
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case of mechanical failure with the designated vessel, we will try to offer a comparable alternative. If that's not possible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger must:
- Adhere strictly to all crew directives
- Utilize safety equipment as instructed
- Disclose any health conditions that could impact their safety
- Stay within designated areas on the yacht
6.2 Prohibited Items
Items not allowed on board include:
- Containers made of glass
- Illegal drugs
- Weapons or firearms
- Excessively indulgent non-alcoholic drinks
- Pets (exclusions apply if approved beforehand)
6.3 Conduct
Passengers should behave in a courteous and respectful fashion. Any behavior deemed risky or disturbing to others may result in the immediate termination of the charter without a refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the charter fee paid by you. We are not liable for:
- Injuries sustained through a passenger's own negligence
- Theft or harm to personal belongings
- Incidental, special, or punitive losses
- Delays due to weather or unforeseen events beyond our control
7.2 Insurance Coverage
We hold full marine insurance for our fleet and operations. It is your responsibility to obtain personal travel and property insurance.
7.3 Assumption of Risk
By using our charter services, you recognize the inherent risks involved in sea-related activities and you take on full responsibility for your security and safety.
8. Modifications and Itinerary Changes
We hold the right to change itineraries, paths, or times based on weather, safety, or operational needs. We will make every effort to offer similar alternative arrangements.
9. Force Majeure
We will not be held accountable for any alterations, postponements, or cancellations caused by events outside our control, which may include but are not limited to:
- Extreme weather situations
- Natural disasters
- Mandates by the government
- Shutdowns of ports
- Unforeseen technical issues
10. Privacy and Data Protection
Your private details are processed according to our Privacy Policy. By utilizing our services, you consent to our data collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
All contents on our site, such as text, visuals, branding, and imagery, are covered by copyright and trademark laws. Unauthorized reproduction, distribution, or derivative creation is prohibited without explicit authorization from us.
12. Governing Law
These Terms are subject to laws relevant in Germany and any disputes will be resolved within the courts of Hamburg, Germany.
13. Changes to Terms
We reserve the option to change these Terms when necessary. Amended Terms will be published on our site with the date of the latest update. Continuous use of our services indicates your agreement to the updated Terms.
